Terms

You and any person who uses a eCard agree to be bound by these terms.

The eCard

The eCard is a payment tool for use as follows:

Physical eCards can be redeemed on our Australian Website or in store at any Nine West Australia concept store. They cannot be purchased or redeemed in Nine West concession store locations in MYER and David Jones.

eCards can be redeemed in full, or can be used in part amounts until the eCard balance reaches zero. If a transaction exceeds the remaining balance on a eCard, you must pay the difference directly to the Nine West store or Nine West online store using alternative means of payment acceptable to the Nine West store at the time of purchase.

You cannot:

Load additional credit onto a eCard;

Redeem a eCard for cash; or

Use a eCard to purchase another eCard.

Purchasing the eCard

Physical eCards can be purchased at Nine West concept stores in Australia (excludes concession stores in Myer and David Jones).

Value & Charges 

eCards may be purchased at a minimum of $20 and a maximum of $500 per card. The purchase price of a eCard corresponds to the chosen value of the eCard.

Activation of the eCard

eCards will have no value until they are activated.

When a physical eCard purchase is made at a Nine West store, the eCard will be activated immediately by a Nine West team member at the point of sale.

On activation the eCard is available for use. There is a PIN code allocated to each eCard. The PIN code is solely for security purposes, for checking the current balance and loss or theft registration (see below).

Expiry

Physical eCards issued after March 31st, 2018 are valid for three years from date of issue (featured on the Gift Voucher).

Any unused balance remaining on a eCard upon expiry shall be forfeited and will not be refunded or credited to you.

Loss of Theft

The eCard should be kept safe at all times and stored with the same care and attention as cash. Nine West shall not be responsible to you for any damage to a eCard or any unauthorised use, loss or theft of a eCard.

Cancellation

Nine West reserves the right to cancel any eCard, or the eCard program for any reason at any time without notice. Upon cancellation by Nine West, the balance on all unexpired eCards will be refunded upon presentation of the eCard to a Nine West store.

General

Governing law: The purchase of a eCard from an Australian Nine West store, will be governed by the laws of the State of Victoria, Australia. 

Privacy: Purchase of a eCard does entail registration of personal data, i.e. name and address of the beneficiary and credit card details of the purchaser. Nine West is committed to preserving the privacy of its customers as detailed in the Nine West Privacy Policy as set out on the Website. Force majeure: Nine West shall not be liable to you for any delay or failure to perform its obligations under these Terms if the cause of such delay or failure is beyond Nine West’s reasonable control. Problem: If you require assistance or have a problem with your eCard you should contact Nine West through its Website.

Amendments to Terms: Nine West may amend these Terms from time to time at its discretion. Any amendments to these Terms will be effective upon publication on the Website.

Definitions

In these Terms, the following words have the following meanings:

"Business Day" means Monday to Friday and excluding public holidays;

"eCard" means a physical gift card issued by Nine West;

"Terms" means these terms as amended from time to time;

"Australian Website" means the website accessed via www.ninewest.com.au

"you" means the purchaser of the eCard and any holder of the eCard for the time being.
